Press Conference Advisory - Ocean Beach Police Brutality

Attorneys D. Carl Lustig, III and Robert C. Gottlieb held a press conference on Tuesday, September 20, 2005 at 11:00 a.m. to announce the filing of a notice of claim against the village of Ocean Beach, Ocean Beach Police Department, and the police department’s Chief of Police and a number of police officers and to demand that the Suffolk county District Attorney investigate and prosecute the village of Ocean Beach police officers who criminally, brutally and viciously attacked a New York City businessman as he was leaving the village police station.

Samuel Gilberd and his wife, Kana Manglapus, took a four day vacation in Ocean Bay Park in late august. In the morning hours of August 28, 2005 after a night out, Mr. Gilberd was brought to the police station to receive a summons for littering. As he was leaving the police station, Mr. Gilberd closed the station house door in a way that offended the police officers. One of the police officers warned Mr. Gilberd “now you’ve really made the sergeant mad” and together with other police officers they violently, brutally and viciously attacked him. Mr. Gilberd was beaten and kicked into unconsciousness and left lying on the station house floor. This unprovoked attack by police officers was witnessed by others. Mr. Gilberd’s wife observed him lying unconscious when she arrived at the station house.

An independent witness to the assault and Mr. Gilberd’s wife frantically insisted that he be brought to a hospital. After a delay, police officers finally transported Mr. Gilberd to Southside hospital via police boat. A few hours later he was brought by private ambulance to St. Vincent’s hospital in New York City where he underwent an emergency operation to repair a ruptured bladder and numerous internal injuries. Mr. Gilberd remained in the hospital for ten days.
To cover up their criminal assault, police officers filed criminal charges seven days later against Mr. Gilberd falsely charging him with resisting arrest and disorderly conduct.
Mr. Gilberd, his wife together with his attorneys Robert C. Gottlieb and D. Carl Lustig, III were to appear at the press conference to answer questions.

As administrator of this blog I have removed blogs that were obviously written by either the DA and/or Police Department. Saying that Mr. Gilberd deserved what happened to him is indicative of the psychopathetic nature of blogger "citizen" which is a word only used by the police. We know who you really are, and look forward to prosecuting.

This whole situation is sad and pathetic. That law enforcement can be so corrupt is disheartening.

SG, I only hope that some of the people who've commented here contact your lawyers and testify at your trial.

Sounds like these cops need some serious disciplinary action -- like indefinite unpaid leave and some crazy-long jail time. Clearly, this has been going on way too long.

The simple bottom line to me is that there is NO crime that justifies this kind of behavior. It sounds to me like some of the "people" (I use the term lightly) posting flames on a blog, hiding behind anonymity, have forgotten that we have courtrooms, Judges and juries to decide punishment for people who break laws.

As I understand the charges (real and trumped-up), they range from littering to resisting arrest. I don't think anyone was charged for attempted homicide of a police officer, or suspicion of terrorism. AND EVEN THEN, the accused would have the right to a trial. No suspect is ever subject to be beaten into a hospital. I would say that the police are supposed to be the “good guys”, but I know better.

And to “citizen” specifically… Mr. Gilberd weighs 130 pounds soaking wet… just how many cops and how much force is needed to “defend themselves” when the deck is stacked in their favor, in the back rooms of their police department?

And for all of you so worried that tourists come to your wonderful city and terrorize the fine, upstanding families and peace officers there by littering and the slamming of doors, fear not! All this great press will keep those monsters (and their tourism dollars) away. When the money runs out, your little town will dry up, and then nobody will be there, not even you.

How is it someone is charged with a misdemeanor, and winds up spending 10 days in the hospital, requiring emergency surgery? You’re SURE that when these police officers “get a little rough” that they are “with in [sic] the scope of the law”? They are “professional in every sense of the word” and they ALWAYS “show self control”?

I’ll offer this little insight: Mr. Gilberd is not the kind of victim these “peace officers” are used to bullying and beating into fearful submission. When he raises his sights to a target, he doesn’t back down and doesn’t quit until he’s exceeded his goal.

This cowardly, anonymous online harassment is yet another thinly veiled attempt to get Mr. Gilberd (and other victims) to back down in fear. A spineless campaign to protect themselves (and those like them) from the law they are supposed to enforce. Well, it’s not going to work like that this time around.

To the likes of citizen: You’re a serial victimizer jarhead, feeling like your freedoms - your rights even - have been violated by those in power. Helpless to defend yourself in an environment where the rules apply differently to you than those you question, outnumbered, and crying abuse of power, you quotes the Constitution and cry Civil Liberties. How ironic, citizen.

Want the freedom to slander Mr. Gilberd further? You have a blog, use it. Don't count on a single person reading your unintelligible ravings, but you ARE free to speak.
And for trashyourtown: I don’t know where to begin, with your idiotic, uninformed personal attacks on Mr. Gilberd’s family, or your ridiculous, fictional abstraction of the events that landed a friend of mine in the hospital, so I’ll just keep it quick with a little advice: Try a line break and a spell-checker, and if you really want to improve yourself - and give your opinion a little credibility – take a remedial English class you embarrassment.

This quote is for all those who promote beatings for misdemeanors. (It also applies to the new Police State imposed in so many ways since 9-11, but that's an argument for another blog.) I assure you, that these people that accuse Mr. Gilberd ("Rape!? Look at that short skirt, she was askin' for it.") would cry loudest the minute someone encroached on THEIR rights.

This is the part that scares me the most. Simply paying the victim a large sum of (taxpayer's) money doesn't solve the problem. Effectively, it coerces their silence, much like the trumped up charges.

These same individuals, WITHOUT badges and buddies to hide behind, would be put through the system they are supposed to be a part of.

They would be arrested, HELD OVERNIGHT (which has already NOT happened), arraigned on charges of assault in front of a Judge, released ON BOND, tried in court, and likely found guilty - based on the facts - and sentenced to a brief incarceration and some probation.

This is the same system that is good enough for the citizens they police, so why not put them through it? What changes if there's a payoff? What lessons do these criminals learn if the taxpayers iron it all out for them with money? If I put someone in the hospital, nobody is going to pay them off for me, I'm going to face the inside of a jail, and the other criminals in there.

This deserves more than just a no-pay vacation slap on the wrist and a settlement. This needs to be handled fairly, as if the criminals were any other citizens.

Hi. I read your tragic story of Police Abuse of Power. Let me first say that I send you the best of regards. Secondly, I have had my fair share of dealings with crooked and corrupt Cops. I have had my name lied on through falsified Police reports, arrested on ficticious charges, and as well have had my name perjured against by the same Cop. This Cop being one pathetic lying Dan Aguilera in Portland Maine. I have decided to make it my life pursuit now to expose corrupt, crooked pigs for what they really are in life.
